What Do You Think Has More Impact At Mediation: showing a video of your client describing the daily anxiety of And while you listen to them describing this routine, you see B-roll footage of them putting together an emergency kit to take whenever they leave their home. Then, it cuts to their spouse discussing how sometimes they need to help with the cathing during the night. Then we cut to a family member describing a recent outing where they had to frantically find a handicapped accessible bathroom, and because they couldn't, they had to leave the event and go home. That event might have been a child's graduation, a family wedding or a Patriots playoff game. How we communicate has been completely overhauled by advancements in technology and social media. In this age of smartphones and tablet and laptop computers, it's no longer enough to tell a story with mere words. Studies over the years have proven that information is understood and retained 60% more when it is seen and heard. It's not enough to stand up in front of a jury and just talk. Those days are long over. This is especially true for members of Generation X and Y. The 90's Grunge anthem, "Smells Like Teen Spirit" plainly states: "Here we are now, entertain us." and this edict has influenced everything we do- from how political campaigns are run and how revolutions are organized to how charities collect money for natural disasters. Both generations were raised gaining knowledge from either a television, computer or a smartphone screen. They are used to a lot of visual stimuli and well-placed sound bytes. They aren't prone to long phone conversations, they rather chat by short texts, email or tweets. This has created an underlying expectation to be shown and "entertained", so to speak, by the information being presented to them. This is why video presentations are essential tools in presenting your cases - either at trial or Mediation. Mediation Presentations and Settlement Communications can be augmented with interviews with your client, spouse, family members, coworkers, friends, treating physicians, and Life Care Planners. This creates a portrait, told through several anecdotes, of the person your client was before the incident, what life is like now, and what the hopes, fears and realities are for the future. The advantages are endless:
With video, you remain in control of the information presented, the entire time. A typical video can average anywhere from $2300-$9500, depending upon the complexity of the project . This doesn't need to be cost prohibitive That is a small price to pay for increasing the value of your settlement award and avoiding the long wait for an expensive trial. |
